2. Scope of These Terms
These Terms apply to:

all orders placed by consumers and business customers through the Website.
If you are purchasing as a consumer (for purposes wholly or mainly outside your trade, business, craft or profession), you have statutory rights under Irish and EU consumer law. Nothing in these Terms limits or excludes those rights.
If you are purchasing as a business customer, some consumer protections described in these Terms may not apply.

We may update these Terms from time to time to reflect changes in our business, the Website, or legal/regulatory requirements.
The version published on the Website at the time you place your order will apply to that order. Please check this page before placing an order.

minor specification changes may occur from manufacturers, and
stock availability may change quickly.
All products are subject to availability. Adding a product to your basket does not reserve stock.
We reserve the right to discontinue products or change product ranges at any time.

Unless otherwise stated, prices displayed on the Website are in euro (€).
Where shown, prices may be displayed inclusive and/or exclusive of VAT depending on the page or customer setting (e.g., inc. VAT / ex. VAT display options). Shipping charges and any additional charges will be shown before checkout.
We take reasonable care to ensure pricing is correct, but errors may occasionally occur. If we discover an obvious pricing error before dispatch:
we may contact you to confirm whether you wish to proceed at the correct price, or
cancel the order and refund any payment made.
We are not obliged to supply products at an incorrect price if the error is obvious and could reasonably have been recognised as a mistake.
7. Ordering Process and Contract Formation
7.1 How to place an order

7.2 Order acknowledgement
After placing an order, you should receive an order confirmation/acknowledgement email. This email confirms receipt of your order request, but does not necessarily mean your order has been accepted.

we send you a dispatch confirmation.
If we cannot accept your order (for example due to stock issues, pricing error, payment authorisation failure, suspected fraud, or delivery restrictions), we will inform you and refund any payment taken.

We reserve the right to refuse or cancel orders where reasonably necessary, including for:

resale/unauthorised commercial buying,

We accept payment methods made available at checkout from time to time.
Payment must be authorised before dispatch. If payment is declined, we are not obliged to process the order.
We do not store full payment card details on our systems unless expressly stated and lawfully processed through secure payment providers.
You confirm that:
the payment details you provide are valid and correct, and
you are authorised to use the chosen payment method.
9. Promotions, Discount Codes and Special Offers
From time to time, we may offer promotional codes, discounts, or special offers.
Unless otherwise stated:
promotions are subject to availability,
cannot be exchanged for cash,
may be time-limited,
may be limited to one use per customer/order,
may exclude certain products/brands/categories,
cannot be applied retrospectively to completed orders.
We reserve the right to withdraw or amend promotions where necessary (including where there has been misuse or an error).
10. Gift Vouchers / Gift Certificates
If you sell gift vouchers or gift certificates through the Website, the following applies (edit as needed):
gift vouchers are redeemable only on finneganscorner.com and/or in-store as stated on the voucher,
vouchers are non-refundable (unless required by law),
vouchers cannot be exchanged for cash,
vouchers may not be resold without our consent,
we are not responsible for lost, stolen, or unauthorised use of vouchers unless caused by our fault,
expiry dates will be stated at the time of purchase.
11. Delivery and Shipping
11.1 Delivery areas
We deliver to the locations shown at checkout. Some products may have delivery restrictions (for example due to size, weight, safety rules, or carrier limitations).
11.2 Delivery times
Any dispatch or delivery times shown on the Website are estimates unless explicitly stated otherwise.
Delays can occur due to courier issues, weather, peak periods, customs, supplier delays, or events outside our control.
11.3 Split shipments
We may deliver an order in instalments/split shipments where necessary (for example if items are sourced from different stock locations), unless prohibited by applicable consumer law or unless we agree otherwise.
11.4 Missed deliveries
If delivery is unsuccessful because incorrect details were provided, no one is available to receive the parcel, or the parcel is not collected from a depot/pick-up point, additional delivery/return charges may apply.
11.5 International orders
For international orders, you may be responsible for import duties, customs fees, taxes, clearance charges, and local compliance requirements in your destination country (unless stated otherwise at checkout).
We are not responsible for delays caused by customs or local authorities.
12. Risk and Ownership
For consumer orders, risk in the goods passes to you when you (or a person identified by you) take physical possession of the goods, unless you arrange your own carrier independently.
Ownership of goods passes to you when:
we have received payment in full (including delivery charges), and
the goods have been delivered.
For business customers, risk may pass earlier in accordance with agreed delivery/incoterm arrangements where applicable.
13. Consumer Right to Cancel (Online/Distance Sales)
If you are a consumer buying online, you may have a legal right to cancel your order within 14 days without giving a reason (subject to legal exceptions).
In general (for goods):
the cancellation period expires 14 days after you (or someone you nominate) receive the goods;

after cancelling, you generally have a further 14 days to return the goods.
We will process refunds in accordance with applicable law. Where a statutory cancellation right applies, refunds are generally made using the same payment method unless you agree otherwise.
13.1 Deductions for diminished value
If you handle goods beyond what is necessary to establish their nature, characteristics and functioning, we may make a deduction from your refund to reflect any diminished value, where permitted by law.
13.2 Return costs under statutory cancellation
Unless we have agreed otherwise or are legally required otherwise, you may be responsible for the direct cost of returning goods when exercising your change-of-mind cancellation right.
13.3 Exceptions to cancellation rights
The statutory right to cancel does not apply in certain cases, including (where applicable):
personalised/custom-made goods,
sealed goods not suitable for return for health/hygiene reasons once unsealed,
goods liable to deteriorate or expire rapidly,
certain leisure/services for a specific date or period,
other exceptions set out by law.

14. Our Returns Policy (Goodwill Policy) — In Addition to Statutory Rights
In addition to your statutory rights, we may offer a goodwill returns policy (for example, returns of most new, unopened items within 30 days of delivery), as stated on our Shipping & Returns page from time to time.
This goodwill policy:
is separate from, and does not replace, your legal rights,
may include conditions (e.g., unopened, unused, resaleable condition, proof of purchase),
may exclude certain items/categories for hygiene, safety, or customisation reasons.
If there is any conflict between our goodwill returns policy and your statutory rights, your statutory rights will prevail.
15. Faulty, Damaged or Incorrect Items
If you receive an item that is:
faulty,
damaged in transit, or
not what you ordered,
please contact us as soon as possible (preferably with your order number and photos where available) so we can resolve the issue.
Where a product is faulty or not in conformity with contract, your rights and remedies are governed by applicable law. Nothing in these Terms limits those rights.
We may ask you to return the item (or provide evidence of the issue) before issuing a replacement, repair, refund, or other remedy, except where not permitted by law.
16. Product-Specific Terms
Because we sell a wide range of products (including toys, bikes, sports/outdoor items, watches, gifts and hobby items), additional terms may apply to certain categories.
16.1 Toys and children’s products
Age recommendations and warnings provided by manufacturers should be followed.
Adult supervision may be required for certain products.
Small parts may present choking hazards for young children.
16.2 Bikes, e-bikes and ride-on products
Bikes and ride-on products must be used in accordance with manufacturer instructions.
Assembly may be required; where applicable, professional assembly/safety checks are recommended.
Customers are responsible for ensuring proper fit, helmet use, maintenance, and safe operation.
Normal wear and tear, misuse, poor maintenance, accidental damage, and unauthorised modifications are not manufacturing defects.
16.3 Outdoor / sports equipment
Use of sports and outdoor equipment carries inherent risk. You are responsible for using products safely and in accordance with instructions, warnings, and applicable safety standards.
16.4 Watches / water resistance / batteries
Where applicable:
water resistance ratings are subject to manufacturer specifications and usage conditions,
battery life estimates are approximate,
warranty/guarantee coverage may be subject to manufacturer exclusions (e.g., accidental damage, misuse, water ingress contrary to rating/use conditions).
16.5 Memorials / decorative items / fragile goods
Fragile items should be checked promptly on delivery. Minor natural variations in materials, finish, colour, or texture may occur and may not constitute a defect.
17. Age-Restricted and Restricted Products
Certain products may be subject to age restrictions, usage restrictions, or delivery restrictions (for example knives, slingshots, archery products, or similar items, where applicable).
By ordering such products, you confirm that:
you are legally entitled to purchase and possess the product in your jurisdiction,
you will use the product lawfully and safely,
the delivery address and recipient comply with applicable laws.
We reserve the right to:
refuse sale,
request proof of age/identity, and/or
cancel/refund an order
